Acceptable Use Policy

1. Scope and Acceptance

This Acceptable Use Policy (the "Policy") governs your access to and use of the EBLIT platform, including our website, mobile application, and all related services (collectively, the "Platform"), which is operated by EBLIT LLC, a Delaware limited liability company ("EBLIT", "we", "us", or "our"). This Policy is incorporated into and forms part of the EBLIT Terms of Service. By accessing or using the Platform, whether as a buyer, a seller, or a visitor, you agree to comply with this Policy in its entirety. If you do not agree, you must immediately cease all use of the Platform. Capitalized terms not defined in this Policy have the meanings given to them in the Terms of Service. EBLIT is a technology service provider and marketplace facilitator; EBLIT is not a party to any transaction between users and does not buy, sell, or take title to any item listed on the Platform. We may update this Policy at any time as described in the section on changes below.

2. Eligibility and Age Requirement

You must be an adult under the laws of your jurisdiction to use the Platform. The minimum age is 18 years by default, and where your state imposes a higher age of majority, that higher age applies to you: (a) the age of majority is 19 in Alabama and Nebraska; and (b) the age of majority is 21 in Mississippi. EBLIT applies the strictest applicable state age of majority. Age is confirmed through the date of birth verified by Stripe Identity during identity verification, and you may not use any feature of the Platform that requires verification unless your verified date of birth establishes that you meet the applicable minimum age. By using the Platform you represent and warrant that you satisfy the applicable age requirement, that you have the legal capacity to enter into binding contracts, and that you are not barred from using the Platform or receiving services under any applicable law. We reserve the right to refuse service to, suspend, or terminate any user who does not meet these requirements.

3. Identity Verification Requirement

EBLIT requires identity verification for activities that carry commitment or risk, including listing items for sale, accepting a delegation, and joining a purchase waiting list. Identity verification is performed through Stripe Identity, a third-party service. By undergoing verification, you consent to the collection and processing of your personal information by Stripe in accordance with Stripe's Privacy Policy. EBLIT receives only a verification result and does not store copies of your government-issued identification documents. EBLIT uses a proprietary identity hashing system, the FirmSecureHash ("FSH"), to create a pseudonymous identifier bound to your verified identity for the purposes of fraud prevention, ownership tracking, and enforcement of this Policy. The methodology of FSH generation is a proprietary trade secret of EBLIT. You may not attempt to submit false, borrowed, stolen, or synthetic identity information, and you may not attempt to complete verification on behalf of another person or allow another person to complete verification on your behalf. Attempting to defeat, spoof, or circumvent identity verification is a serious violation of this Policy.

4. Prohibited Items

The following items may not be listed, offered, sold, or exchanged on the Platform under any circumstances: (a) firearms, weapons of any kind, ammunition, firearm parts or accessories, and explosives; (b) controlled substances, illegal drugs, drug paraphernalia, and any other regulated substances whose sale or transfer requires a license, permit, or prescription; (c) adult content, sexually explicit materials or services, and any other age-restricted goods including alcohol, tobacco, vaping products, and cannabis products; (d) live animals, and human remains, organs, or body parts; (e) any item the sale, transfer, possession, or shipment of which requires a license, permit, registration, or governmental authorization that the seller does not lawfully hold, or that cannot lawfully be transferred through a peer-to-peer marketplace; (f) stolen property, counterfeit or infringing goods, and any item obtained through fraud; (g) items subject to export, import, or sanctions restrictions, hazardous materials, and recalled products; and (h) any item whose listing, sale, or shipment would violate applicable federal, state, or local law. EBLIT requires that every listed item carry an accurate, unaltered unique identifier (such as an IMEI, VIN, or serial number) where one applies; listing an item with a removed, altered, or falsified identifier is prohibited.

5. Prohibited Activities and Platform Abuse

You may not engage in any of the following activities on or through the Platform: (a) manipulating, gaming, or abusing the purchase waiting list, queue, selection, or ratings systems; (b) spoofing, falsifying, or otherwise circumventing GPS or location verification during meetup or shipping flows; (c) filing false, duplicate, or bad-faith disputes, submitting fabricated evidence, or abusing the dispute resolution system; (d) misrepresenting an item, its condition, its ownership, or its identifier, or engaging in any form of fraud or deceptive conduct; (e) harassing, threatening, stalking, intimidating, or abusing other users or EBLIT personnel; (f) uploading or transmitting malware, attempting unauthorized access to any account or system, scraping, or reverse engineering any component of the Platform; (g) creating listings for items you do not possess or have no right to sell; and (h) any other conduct that interferes with the integrity, security, or proper functioning of the Platform. Violations may result in immediate suspension or termination and may expose you to civil or criminal liability.

6. Off-Platform Transactions and Fee Circumvention

The Platform's safety, verification, and payment-integrity protections apply only to transactions completed on the Platform. You may not use the Platform to solicit, arrange, or complete any transaction outside of the Platform with a counterparty you met through EBLIT, and you may not attempt to move a transaction off-Platform in order to avoid EBLIT fees, identity verification, GPS verification, dispute protections, or any other Platform control. Sharing contact information, payment handles, or external links for the purpose of transacting off-Platform, quoting an off-Platform price to induce a counterparty to leave, or otherwise circumventing or attempting to circumvent EBLIT's fees or safeguards is strictly prohibited. Because EBLIT is not a party to any transaction and its protections do not extend beyond the Platform, off-Platform dealing exposes you to fraud and forfeits any recourse EBLIT could otherwise provide. This conduct is grounds for enforcement up to and including permanent termination.

7. Ban Evasion and Identity Evasion

If your account is suspended or banned, you may not access the Platform, and you may not create, operate, or use another account to evade that suspension or ban. You may not register a new account using a different name, email address, device, or payment method to circumvent an enforcement action. Because verified identity is bound to a pseudonymous FirmSecureHash (FSH) derived through Stripe Identity, EBLIT is able to detect when a new registration matches the verified identity of a previously banned user. When such a match is detected, the new account is flagged for review, and EBLIT may suspend or terminate it and take further enforcement action. Attempting to defeat identity verification, to use another person's verified identity, or to obtain a new FSH in order to evade enforcement is a severe violation of this Policy. Identity evasion and ban evasion may also be referred to law enforcement where appropriate.

8. Funds and Payment Integrity

EBLIT uses Stripe, Inc. as its payment processor. When a buyer completes checkout, funds are collected by Stripe on behalf of EBLIT and held pending successful completion of the transaction. Funds held pending confirmation are not held in a bank account operated by EBLIT and are not commingled with EBLIT's operating funds; release to the seller occurs only upon successful completion of the transaction. EBLIT is not a bank and not a money transmitter, and the holding of funds pending confirmation is a purely technical function of the payment processing infrastructure that does not constitute a deposit or investment. You may not abuse the payment or funds-holding mechanism, including by initiating fraudulent chargebacks, misusing refunds, structuring transactions to obscure their true nature, or attempting to extract funds through false claims. Abuse of the payment system is a violation of this Policy and may be reported to Stripe and to law enforcement.

9. Enforcement and Graduated Penalties

EBLIT enforces this Policy through a graduated system of penalties calibrated to the severity and frequency of the violation. Depending on the conduct, enforcement may include a warning, removal of a listing, a strike against your account, temporary suspension of selling or buying privileges, or permanent account termination and blacklisting. Certain violations, including identity mismatch, ban or identity evasion, prohibited-item listings, GPS spoofing, and fraud, may result in immediate termination without a prior warning. Where a violation is discovered after a transaction has been completed and a refund is warranted, EBLIT may recover the corresponding amount from the seller by clawing back the seller's payout; in the case of a partial refund, the amount clawed back is the lesser of the refund amount and the seller's payout (that is, min(refund, payout)), and this clawback is borne by the seller. EBLIT determines the appropriate enforcement action in its reasonable discretion based on the available evidence. Enforcement under this Policy is in addition to, and does not limit, any other remedy available to EBLIT under the Terms of Service or applicable law.

10. Reporting Violations

If you become aware of any content, listing, user, or activity on the Platform that violates this Policy, or if you believe an item is stolen, counterfeit, prohibited, or fraudulently listed, you should report it promptly. Reports and other Policy concerns may be submitted by email to support@eblit.com. You must report any identity mismatch discovered during a meetup transaction immediately through the Platform; failing to report a known identity mismatch, or attempting to proceed despite one, is itself a violation of this Policy. EBLIT reviews reports and takes enforcement action where warranted, but EBLIT does not guarantee any particular outcome or response time and may decline to act on reports that are unfounded or made in bad faith. Submitting knowingly false reports is a violation of this Policy.

11. Cooperation with Law Enforcement

EBLIT cooperates with law enforcement and regulatory authorities. EBLIT may preserve, disclose, and produce account records, verification results, transaction data, communications, dispute records, and other information when EBLIT believes in good faith that doing so is necessary to comply with a subpoena, court order, or other legal process, to investigate suspected fraud or other unlawful activity, to protect the safety of any person, or to enforce this Policy and the Terms of Service. Dispute and compliance records are retained for the periods described in the Terms of Service. EBLIT may refer suspected criminal conduct, including the sale of stolen or prohibited items, fraud, identity evasion, and ban evasion, to the appropriate authorities. Nothing in this Policy limits EBLIT's ability to fulfill its legal obligations.

12. Changes to This Policy

EBLIT may modify this Policy at any time. We will reflect material changes by updating the Last Updated date at the top of this page and, where appropriate, by providing additional notice. Your continued use of the Platform after any modification constitutes your acceptance of the modified Policy. If you do not agree to the modified Policy, you must cease using the Platform.

13. Governing Law and Venue

This Policy is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under or relating to this Policy shall be brought exclusively in the federal or state courts located in Collin County, Texas, and you consent to the personal jurisdiction and venue of such courts. If any provision of this Policy is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
