DMCA and Intellectual Property Policy

1. Overview
This DMCA and Intellectual Property Policy (the "Policy") describes how EBLIT LLC, a Delaware limited liability company ("EBLIT," "we," "us," or "our"), responds to claims of copyright infringement on the EBLIT platform (the "Platform") under the Digital Millennium Copyright Act, 17 U.S.C. 512 (the "DMCA"). EBLIT respects the intellectual property rights of others and expects users of the Platform to do the same. EBLIT operates as an online service provider that hosts user-generated listings, images, descriptions, and related content. We do not routinely pre-screen this content, but we will respond expeditiously to valid notices of claimed infringement in accordance with this Policy and the DMCA.
2. Designated Copyright Agent
EBLIT has designated an agent to receive notifications of claimed copyright infringement. EBLIT's DMCA agent may be contacted by email at support@eblit.com. You may also direct DMCA correspondence to dmca@eblit.com, which forwards to support@eblit.com; support@eblit.com is the operative address for all notices and counter-notifications. EBLIT maintains its designated-agent registration with the United States Copyright Office as required to claim the safe harbor under Section 512(c) of the DMCA. Notices and counter-notifications are submitted to EBLIT by email; EBLIT does not accept DMCA correspondence by any other method described on this page.
3. Filing a Notice of Claimed Infringement
If you are a copyright owner, or authorized to act on behalf of one, and you believe that content on the Platform infringes your copyright, you may submit a written notification of claimed infringement to EBLIT's designated agent at support@eblit.com. To be effective under 17 U.S.C. 512(c)(3), your notification must be a written communication that includes substantially all of the following elements: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works; (c) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit EBLIT to locate the material, such as the listing URL, the listing identification number, or the unique product identifier associated with the listing; (d) information reasonably sufficient to permit EBLIT to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted; (e) a statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and UNDER PENALTY OF PERJURY, THAT THE COMPLAINING PARTY IS AUTHORIZED TO ACT ON BEHALF OF THE OWNER OF AN EXCLUSIVE RIGHT THAT IS ALLEGEDLY INFRINGED.
4. EBLIT's Response to a Valid Notice
Upon receipt of a notification that substantially complies with the requirements of 17 U.S.C. 512(c)(3), EBLIT will expeditiously remove or disable access to the material that is claimed to be infringing. EBLIT will take reasonable steps to notify the user who posted the material that the material has been removed or disabled. If a notification does not substantially comply with the statutory requirements, it may not be effective, and EBLIT may not be obligated to act on it; however, EBLIT may, in its discretion, contact the complaining party to request that the notification be corrected. Removal or disabling of access to material in response to a notice is not an admission of liability by EBLIT or by any user and does not constitute a determination that infringement has in fact occurred.
5. Filing a Counter-Notification
If you are a user whose material has been removed or disabled and you believe the material was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to EBLIT's designated agent at support@eblit.com. To be effective under 17 U.S.C. 512(g)(3), your counter-notification must be a written communication that includes substantially all of the following elements: (a) a physical or electronic signature of the user; (b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled, such as the listing URL or listing identification number; (c) a statement UNDER PENALTY OF PERJURY THAT THE USER HAS A GOOD-FAITH BELIEF THAT THE MATERIAL WAS REMOVED OR DISABLED AS A RESULT OF MISTAKE OR MISIDENTIFICATION OF THE MATERIAL TO BE REMOVED OR DISABLED; and (d) the user's name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or, if the user's address is outside the United States, for any judicial district in which EBLIT may be found, and that the user will accept service of process from the person who provided the original notification of claimed infringement or an agent of that person.
6. Restoration of Material Following a Counter-Notification
Upon receipt of a valid counter-notification, EBLIT will promptly provide the person who submitted the original notification of claimed infringement with a copy of the counter-notification and will inform that person that EBLIT will replace the removed material or cease disabling access to it in not less than ten (10) nor more than fourteen (14) business days following receipt of the counter-notification. EBLIT will replace the removed material and cease disabling access to it within that timeframe, unless EBLIT's designated agent first receives notice from the person who submitted the original notification that such person has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Platform. EBLIT does not restore material, and does not act as a mediator, arbiter, or adjudicator of the underlying copyright dispute between the parties.
7. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, EBLIT has adopted a policy of terminating, in appropriate circumstances and at EBLIT's sole discretion, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if the user has uploaded, posted, or otherwise made available material that is the subject of more than one valid notice of claimed infringement, or if the user is otherwise found to have repeatedly infringed the intellectual property rights of others. EBLIT may also, in appropriate circumstances and in its sole discretion, limit access to the Platform, remove listings, or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement. Account termination for repeat infringement is tied to EBLIT's general account termination rights and may result in the permanent loss of access to the Platform.
8. Misrepresentation Liability
Under Section 512(f) of the DMCA, ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL OR ACTIVITY IS INFRINGING, OR THAT MATERIAL OR ACTIVITY WAS REMOVED OR DISABLED BY MISTAKE OR MISIDENTIFICATION, MAY BE LIABLE FOR DAMAGES, INCLUDING COSTS AND ATTORNEYS' FEES, INCURRED BY THE ALLEGED INFRINGER, BY ANY COPYRIGHT OWNER OR COPYRIGHT OWNER'S AUTHORIZED LICENSEE, OR BY EBLIT, WHO IS INJURED BY SUCH MISREPRESENTATION AS THE RESULT OF EBLIT RELYING UPON SUCH MISREPRESENTATION IN REMOVING OR DISABLING ACCESS TO THE MATERIAL OR ACTIVITY CLAIMED TO BE INFRINGING, OR IN REPLACING THE REMOVED MATERIAL OR CEASING TO DISABLE ACCESS TO IT. Before submitting a notice or counter-notification, you should consult an attorney or review the requirements of the DMCA to confirm that your submission is accurate and made in good faith.
9. Trademark, Counterfeit, and Other Intellectual Property
This Policy addresses claims of copyright infringement under the DMCA. Claims involving trademarks, counterfeit or unauthorized replica goods, the sale of items that infringe the intellectual property rights of others, and other intellectual property violations are governed by EBLIT's Acceptable Use Policy, which prohibits the listing or sale of counterfeit, unauthorized, or intellectual-property-infringing goods on the Platform. If you believe a listing infringes a trademark or offers counterfeit goods, please review the Acceptable Use Policy and contact EBLIT at support@eblit.com so that we can direct your report to the appropriate process. EBLIT may remove listings and take enforcement action, including account termination, in response to trademark and counterfeit complaints in accordance with the Acceptable Use Policy and applicable law.
10. Governing Law
This Policy is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles, and by applicable federal law including the DMCA. Any dispute arising out of or relating to this Policy that is not subject to the federal jurisdiction consent described in Section 5 shall be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction and venue of those courts.
11. Changes to This Policy
EBLIT may update this Policy from time to time. Changes will be reflected by updating the Last Updated date at the top of this page. Your continued use of the Platform after any change becomes effective constitutes your acceptance of the updated Policy.
